1. INTRODUCTION

1.1. Catherine Mycock-Overell trading as Cat the Science Tutor (“Cat”) is a private tutor.

1.2. These T&Cs set out the terms under which Cat will provide tutoring services to students (“You”). If You are under 18 then these tutoring services are deemed to be provided at the request of a parent or guardian (“Your Parent/Guardian”).

 

2. GENERAL

2.1. These T&Cs are binding on Cat, You, and Your Parent/Guardian.

2.2. Cat reserves the right to alter these T&Cs.

2.3. No variation or alteration of these T&Cs by You or Your Parent/Guardian shall be valid unless expressly approved in writing by Cat.

2.4. These T&Cs are governed by the laws of England and Wales and the parties submit to the jurisdiction of the Court of England and Wales.

 

3. INITIAL CONSULTATION

3.1. Cat offers a free initial consultation lasting up to 1 hour (“Initial Consultation”) to all prospective students.

3.2. The Initial Consultation takes place at Your home with You and Your Parent/Guardian (if applicable).

3.3. The purpose of the Initial Consultation is to allow You and Cat to meet so You can decide if Cat’s tutoring services are suitable for Your needs, and so Cat can obtain information about You in order to provide tutoring suitable to Your needs.

3.4. If You decide to engage Cat to provide You with tutoring services, at the end of the Initial Consultation You and/or Your Parent/Guardian will need to:

3.4.1. Complete and sign the Parental Consent Form;

3.4.2. Review and sign the Data Privacy Notice & Consent Form; and

3.4.3. In the case of Tutorials starting partway through the academic year, agree a day and time for the selected tutoring services.

 

4. TUTORING SERVICES

4.1. Tutorials

4.2. Cat will provide tutoring sessions (“Tutorials”) to You:

(a) on the day and time;

(b) for the duration; and

(c) at the location

agreed in the Initial Consultation, or as subsequently agreed in writing between Cat and You and Your Parent/Guardian (if applicable).

4.3. The agreed day/time of Tutorials will be subject to renewed agreement at the start of each academic year. During each academic year, it will not be possible to change the day/time of Tutorials except in exceptional circumstances and at Cat’s sole discretion.

4.4. Tutorials will, unless cancelled pursuant to clause 6, take place weekly at the agreed day/time (and incur the fee pursuant to clause 5.1) until terminated pursuant to clause 7. This includes during school holidays with the exception of the period from and including the last Saturday before Christmas Eve to the first Sunday after New Year’s Day, during which no regular Tutorials will take place.

4.5. In the event of illness, notification under clause 8.3, or any other event (whether affecting You, Your Parent/Guardian, or Cat) which means that You are able to participate in a scheduled Tutorial but it is not possible for it to take place in person, the Tutorial will take place online unless cancelled.

4.6. Revision Sessions

4.7. Cat offers one-to-one revision sessions (“Revision Sessions”) lasting either 3.5 hours or 2 hours. Revision Sessions lasting 3.5 hours include two short breaks totalling 30 minutes.

4.8. Cat will also on request deliver Revision Sessions to groups of 2 or 3 students (“Group Revision Sessions”).

4.9. A Revision Session (or Group Revision Session, as applicable) will take place at the location and on the date and time agreed in writing between Cat and You and Your Parent/Guardian (if applicable). In the event of illness, notification under clause 8.3, or any other event (whether affecting You, Your Parent/Guardian, or Cat) which means that You are able to participate in a scheduled Revision Session but it is not possible for it to take place in person, the Revision Session will take place online unless cancelled.

4.10. Standard of Tutoring Services

4.11. Cat will carry out the tutoring services professionally, with due skill, diligence and care.

4.12. Cat is responsible for the content of Tutorials and Revision Sessions and will prepare that content in accordance with Your instructions and/or the relevant exam syllabus or qualifications syllabus or national curriculum, as appropriate.

4.13. Whilst Cat will, on request, review marked work or practice papers with You in the course of Tutorials or Revision Sessions, Cat will not do homework or assignment questions that are meant to be Your own work.

 

5. PAYMENT

5.1. Fees are as follows:

5.2. Discounted fees per student are available for Group Revision Sessions and will be notified to You directly by Cat in advance.

5.3. Subject to clause 5.4, fees must be paid to Cat at or before the end time of each Tutorial or Revision Session. Cat will not issue invoices for individual Tutorials or Revision Sessions except by prior arrangement.

5.4. Cat will, on request, issue a monthly invoice at the start of each month in respect of Tutorials and any booked Revision Sessions for that month. The full balance of each monthly invoice must be paid within seven days of the date on the invoice.

5.5. Payment must be made by You or Your Parent/Guardian by bank transfer to the details notified to you at the Initial Consultation or to such bank details as may subsequently be notified to You and Your Parent/Guardian by Cat in writing.

5.6. In the event of non-payment, Cat reserves the right to suspend all future tutoring services to You until the overdue payment is made.

 

6. CANCELLATION

6.1. Cancellation by You or Your Parent/Guardian

6.2. Cancellations must be notified in writing in advance or, in exceptional circumstances, orally in conversation with Cat, in which case Cat will confirm the cancellation in writing.

6.3. The Required Notice for cancellation of a Tutorial or Revision Session is:

(a) For Tutorials or Revision Sessions during all school holidays except the Christmas holidays (i.e. October half term, February half term, the Easter holidays, May half term, and the summer holidays), notice of 7 days before the last day of the school term immediately preceding the holiday;

(b) For Tutorials or Revision Sessions during exam season, i.e. from the Monday of the first week of external exams (GCSE or A-Level, whichever is earlier) to the Friday of the last week of external exams (GCSE or A-Level, whichever is later) (but excluding May half term), 7 days’ notice; or

(c) During the rest of the year, 48 hours’ notice.

6.4. If You or Your Parent/Guardian cancel a Tutorial or Revision Session with at least the Required Notice, no fee will be payable.

6.5. If You or Your Parent/Guardian cancel a Tutorial or Revision Session with less than the Required Notice, the full fee for that Tutorial or Revision Session will be payable at the date and time of the cancelled Tutorial or Revision Session (the “Cancellation Fee”).

6.6. Cat reserves the right to waive the Cancellation Fee in her absolute discretion.

6.7. Cancellation by Cat

6.8. If Cat needs to cancel a Tutorial or Revision Session, she will

(a) notify You and Your Parent/Guardian as soon as possible; and

(b) use all reasonable endeavours to arrange a replacement Tutorial or Revision Session (as applicable) at a mutually convenient time.

6.9. In the event of a cancellation by Cat, no fee will be payable for the cancelled Tutorial or Revision Session. If Cat is holding payment on account following payment of a monthly invoice, the fee for the cancelled Tutorial or Revision Session will be applied as a credit against the next Tutorial or Revision Session not covered by the payment held on account.

 

7. TERMINATION
7.1. Tutorials will continue (and payment of the fee will be due in respect of each Tutorial unless cancelled pursuant to clause 6.3) until the earlier of:

(a) a termination date which is mutually agreed (and confirmed in writing); or

(b) the date of the fourth consecutive session cancelled by You (or Your Parent/Guardian) or which You fail to attend, unless expressly agreed otherwise by Cat; or

(c) payment for a Tutorial is four weeks overdue (i.e. the date four weeks after the Tutorial for which payment was not made),

on which date Your Tutorials will be terminated and Cat may offer Your day/time to another student.

 

8. YOUR CONDUCT

8.1. If You are late to a Tutorial or Revision Session:

(a) Cat may choose, but is not obliged, to extend the end time by an equivalent amount of time, however Your Parent/Guardian must still be present to collect you at the scheduled end time, regardless of the time You arrive (and if Cat chooses to extend the end time with Your agreement then Your Parent/Guardian must be prepared to wait until that later finish time); and

(b) The usual fee will be payable, whether or not Cat extends the scheduled end time.

8.2. You agree to comply with the Student Code of Conduct.

8.3. If You receive a positive test for Covid-19 or develop symptoms of Covid-19 (new or worsened persistent cough, fever, or any other symptoms notified by the public health authorities of Covid-19) You must:

(a) Notify Cat of the date of Your positive test and/or onset of symptoms; and

(b) Not attend and Tutorials or Revision Sessions in person until at least 10 days after the date of the positive test or onset of symptoms (whichever is the earlier).

8.4. Clause 8.3 will also apply to Cat, mutatis mutandis.

 

9. COPYRIGHT

9.1. All materials created by Cat are protected by copyright.

9.2. Materials used during Tutorials or Revision Sessions not created by Cat are used under licence.

9.3. You agree that You will not publish or distribute any portion of any materials provided by Cat without prior written permission from Cat.

 

10. DATA PROTECTION
10.1. Cat is registered with the ICO with registration number ZA298258.

10.2. Cat will only process Your data in line with applicable data protection legislation. The uses for which Cat may process Your data are set out in the Data Privacy Notice & Consent Form and available on request by email to Cat.

 

11. LIMITATION OF LIABILITY

11.1. Cat strives to provide the best possible service, and will use all reasonable endeavours to help you achieve the results You want. However, Cat cannot and does not offer any guarantee of any particular result or grade, and will not be held liable or responsible for the academic success or lack thereof demonstrated by You.

11.2. Save as set out in Clause 11.3, Cat will not be liable to You or to Your Parent/Guardian or to any third party for any direct, indirect, consequential, special, punitive or other losses or damages arising out of use of Cat’s tutoring service, or any errors or omissions in the content of Cat’s materials.

11.3. Cat does not exclude liability that is not permitted to be excluded by law, and in particular Cat does not exclude liability for death or personal injury arising from Cat’s own negligence.

 

12. NOTICES AND COMMUNICATIONS

12.1. Communications and notices that are required by these T&Cs to be “written” or “in writing” must be sent by email to:

(a) cat@catthesciencetutor.co.uk (or to such other email address as Cat may notify from time to time) for communications and notices to Cat; and

(b) The email address notified on the Parental Consent Form (or to such other email address as You may notify from time to time) for communications and notices to You and to Your Parent/Guardian.
